Standard Terms & Conditions

Customers are requested to read the following terms and conditions before entering into a contract with Virage Helicopters Academy LLP ("we", "the company"). By undertaking a flight or service with Virage Helicopter Academy, the customer agrees to the terms and conditions contained within this document. Our Terms & Conditions do not affect consumers' statutory rights under common law. The company reserves the right to vary or revoke these terms as it may consider appropriate.

Definitions

"Customer" means the person or business who/which orders or submits a deposit or purchases a lesson/voucher/product/service.

"Price" means the cost of the product or service inclusive of VAT at the current rate.

"Recipient" means either the customer or the nominated person who will redeem a Trial Lesson voucher/Gift Voucher or undertake a training flight.

"The company" refers to Virage Helicopter Academy LLP and all its employees.

"Trial Lesson Voucher" means the voucher issued by the company, which entitles the customer or recipient to the flight detailed therein.

"Gift Voucher" means the voucher issued by the company, which entitles the customer or recipient to the value stated to be deducted from the purchase cost of a Trial Lesson provided by Virage Helicopter Academy LLP.

“Self-Fly Hire” means rental of an aircraft to a suitably qualified pilot for the purpose of conducting a private flight.

General

All flight descriptions, statements, representations and illustrations contained on the company's website, the company's advertising or otherwise communicated shall not bind the company in any way. The company reserves the right to alter any descriptions, statements, representations and illustrations at any time. Whilst we make every effort to ensure the descriptions, statements, representations and illustrations contained within our website are a true reflection of the product, they do not form part of any contract.

Health

By booking any form of Trial lesson or training flight the customer and/or recipient confirms that he or she is medically, physically and mentally fit to participate in it. If a customer or recipient has any medical condition or disability or knows of any other factor, which may adversely affect his or her participation, he or she must advise the company at the time of booking. The company reserve the right to decline a request for a flight if we consider that we cannot properly meet that individual customer's or recipient's needs and requirements, or if we consider that participation should be refused for safety reasons.

All purchasers of trial lessons and training flights should be aware that the helicopter produces a ‘Flicker effect’ when the rotor blades are turning. Purchasers of flights and vouchers must ensure that the person flying is not prone to any condition (such as epilepsy) that may be triggered by flicker effect.

Gift Vouchers

Gift vouchers must be used as part payment for a trial lesson which must be booked in advance of the flight. Please do not arrive at our location expecting to redeem your gift voucher without first receiving a booking confirmation.

Voucher validity: The voucher remains valid for a period of 12 months from the date of purchase.

Voucher presentation: The customer or recipient will not be permitted to commence the flight unless they are in possession of the Trial lesson voucher on the day of the flight and present it to the company.

Voucher transfer: Vouchers are non-transferable. Valid only for the person named on the voucher.

Voucher issue: On confirmation of payment of the price by the customer the company shall issue the voucher(s) to the customer.

Voucher loss: In the event of voucher loss the company, at their discretion, may replace the voucher. The company reserve the right to refuse a request for a replacement voucher and the flight may be forfeited.

Payment of balance: The difference between the Gift voucher value and the Trial Lesson value must be paid in full, with cleared funds before the commencement of the flight.

Trial Lesson Vouchers

Voucher validity: The voucher remains valid for a period of 12 months from the date of purchase. The customer or recipient will not be permitted to commence the flight unless they are in possession of a valid Trial Lesson voucher.

Voucher presentation: The customer or recipient will not be permitted to commence the flight unless they are in possession of the Trial lesson voucher on the day of the flight and present it to the company.

Voucher transfer: Vouchers are non-transferable. Valid only for the person named on the voucher.

Voucher loss: In the event of voucher loss the company, at their discretion, may replace the voucher. The company reserve the right to refuse a request for a replacement voucher and the flight may be forfeited.

The timing of a flight as booked or otherwise communicated is given as a guide only and shall not be binding on the company. The company reserves the right to reschedule the time or date of any flight at short notice. The company will endeavour to minimise any delay, amendment or cancellation of a planned flight but some events that are beyond the control of Virage Helicopter Academy may affect the ability to carry out a flight and as such unavoidable delays or cancellation may occur.

Flight Restrictions

Gift vouchers, Trial lesson vouchers and PPL(H) training flights are offered subject to certain passenger weight and height restrictions. Due to the internal size and maximum overall weight that the helicopter can carry as determined in the Aircraft Flight manual, we require that the purchaser of a Gift voucher/Trial lesson voucher or training flight declare to Virage Helicopter Academy LLP at the time of booking if the passenger who will undertake the flight is a weight greater than 220lbs/ 100kg/15st 10lb or if they are of a height greater than 6’4” (193cm). Virage Helicopter Academy reserves the right to refuse the carriage of persons exceeding these limits on the grounds of safety. We are not responsible for any unsuitable vouchers being purchased and these restrictions being breached. If you are unsure of the suitability of a particular voucher please either call or email us at training @virage-heli.co.uk with your query and we will respond accordingly.

Self-Fly Hire

Self-Fly Hire if offered subject to the following requirements;

Pilot in command holds a valid and current JAR-FCL Licence at PPL(H) level or above.

Pilot in command holds a current medical certificate.

Pilot in command has flown the H269 within the last 28 days. If the PIC has not flown within this recency period a check flight with an instructor will be required prior to Self-Fly Hire. The length and contents of the check flight will be at the instructors discretion based upon the recency and skill level of the pilot being checked.

Requests for use of the aircraft in the three seat configuration must be made prior to the day of flight and must be authorised by the CFI or Instructor on duty. Strict adherence to the weight and balance limitations as well as minimum fuel requirements as laid down in the company Flying Order Book must be observed.

Full payment for the flight will be due at the current rate immediately after the flight.

The PIC must comply with the rules set out in the company Flying Order Book with reference to Self-Fly Hire.


PPL(H) Training

Booking: Training flights may be booked by e-mail or telephone.

Full payment for the flight will be due at the current rate immediately after the flight.

Cancellations and Refunds

All flights are offered subject to availability and weather conditions. The company will endeavour to complete the flight on the booked date and time but cannot guarantee that the flight will not be cancelled due to availability or adverse weather conditions. Under such circumstances the flight will be rescheduled to a date suitable to the customer. If the flight has been rescheduled more than 3 times by the company, for any reason, the customer may request a full refund of the price paid.

Technical cancellation: Should cancellation of the flight occur due to aircraft technical reasons, the company will contact the purchaser to rearrange the flight.

Booking alterations: Changes to a booked flight are permitted with 48 hours notice. Requests for an alteration within 48 hours of the booked flight will be at the discretion of the company.

Cancellation of a booking by the customer within the 24 hour period preceding a flight will incur a cancellation fee of £25. This will be payable before the company will provide any further service to the customer.

Refunds

Where a refund has been agreed by both the customer and the company the refund will always be made to the original purchaser and if purchased by credit card, refunds will be credited to the same card.

Pricing

The price stated on the website and brochures/leaflets or otherwise communicated is correct at the time of going to press or when communicated but the company reserves the right to change prices without notice subject to the company informing the customer of the new price at the time of ordering. The customer shall pay the price in full at the time of purchasing and no voucher shall be issued unless the full price has been paid. Trial Lesson and Gift Voucher prices include VAT unless otherwise stated. All other services and product will be subject to VAT at the current rate.

Payment

Payment for training and vouchers may be by credit card, debit card, cash or cheque. The following fee’s apply:

Credit card payment 2.5% of price

Cash payment above £250 £5.00 handling fee

Conditions of Carriage

Virage Helicopter Academy LLP will not seek to limit or exclude its liability in the event a passenger dies or is injured as a result of an accident on any of its flights. If it is proved that the passenger has caused or contributed to his injury or death by his own negligence, then Virage Helicopter Academy LLP may be exonerated wholly or in part from its liability in accordance with the law. For damages actually suffered up to SDR100,000 can be met, subject always to the overall obligation to prove the extent of your loss. If your damages exceed this sum, you will have to prove negligence before you can claim for the excess over SDR100,000 can be met, subject always to the overall obligation to prove the extent of your loss. If you or your family suffer immediate economic needs as a result of an accident then an advance payment of damages will be made by Virage Helicopter Academy LLP. In the event of death, this advance payment will not be less than SDR15,000 or its Sterling Equivalent. Any sum paid in advance will have to be accounted for when any damages payable to you or your family are finally determined. The potential liability of Virage helicopter Academy is insured up to / beyond a reasonable overall limit recommended / prescribed by the CAA.

Virage Helicopter Academy reserves the right to refuse the carriage of any passenger on any flight if the company believes that the passenger is not fit to be carried. Customers should be aware that passengers under the influence of alcohol or drugs would not be permitted to undertake a flight.
